ALL BIDDERS HEREBY CERTIFY THAT THEY HAVE READ AND FULLY UNDERSTAND THE TERMS AND CONDITIONS AND THEY AGREE TO BE BOUND THEREBY. Each auction may have additional terms not listed here. It is the buyer's responsibility to understand all the terms and conditions prior to submitting a bid. Because the Internet occasionally experiences disruptions, Kansas Impound Auctions cannot guarantee its services will be available 100% of the time. Although Kansas Impound Auctions strives to provide the most reliable services possible, interruptions and delays in service are unavoidable and Kansas Impound Auctions disclaims any liability for damages resulting from such disruptions. Thus, you use this Web site at your own risk.

All Bidders must register and be in good standing with Kansas Impound Auctions in order to bid on vehicles listed in online auctions. Kansas Impound Auctions reserves the right to remove a bidder for not complying with the terms and conditions.

BID DEFINITION

A bid is a binding contract, which obligates you to complete the purchase of the vehicle if you are the winning bidder. Once the bid has been placed, it cannot be cancelled or retracted. So, you should be sure that you wish to purchase a vehicle before placing any bids. Vehicles offered \"AS IS, WHERE IS\" All vehicles are sold \"as is, where is\" with no warranty or guarantee expressed or implied. Inspection of the vehicles before bidding is strongly encouraged and recommended. Written or verbal descriptions from the seller, seller's agent or Kansas Impound Auctions are not guaranteed. Bidder's are responsible for inspection of the vehicles and will not be issued a refund for any reason. The Seller's contact information and location of the item will be provided with the listing description of each item for sale.

CONDITION

All vehicles purchased through Kansas Impound Auctions are sold "AS-IS WHERE-IS", WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY. Certain jurisdictions permit vehicles to be sold with missing VIN plates, and as a result Kansas Impound Auctions does not guarantee that vehicles are equipped with any or all VIN plates. Kansas Impound Auctions do not guarantee that vehicles meet or can be modified to meet local emission and/or safety requirements. It is the sole responsibility of Buyer to inspect, confirm, research, and/or investigate vehicles and any and all information regarding the type, status, condition, and history of vehicles prior to bidding on them. No warranty is made by Kansas Impound Auctions with respect to the accuracy of any information provided by Kansas Impound Auctions to Buyers regarding vehicles, provided in either written, or image form and Buyer should not base their bids solely on information provided for Buyers' convenience. This information includes, but is not limited to year, make, model, condition, mileage, odometer disclosure, actual cash value, VIN, damage type, whether or not vehicle starts, whether or not vehicle has keys. Kansas Impound Auctions does not guarantee that keys are available for any vehicle purchased through Kansas Impound Auctions regardless of whether keys are present in online vehicle images, or were present in the vehicle prior to the time of purchase. No guarantee as to the condition of the engine (including if it will start again) or any of its components is expressed or implied. Kansas Impound Auctions assumes no responsibility for fire, acts of God, theft, or other loss or damage to any vehicle or equipment once it has been released to the buyer or buyer's transporter.

PICTURES

Photos may or may not depict all the good and bad of the vehicle. The best way to determine the condition is to personally inspect the vehicle yourself. Photos and descriptions are to be used as a guide only.

AUCTION CANCELLATION

Kansas Impound Auctions may, at any time, in its sole discretion and with or without notice, postpone or cancel a sale. Kansas Impound Auctions will neither be liable or obligated to the Buyer as a result of any auction postponement or cancellation.
Vehicle Withdrawal or Removal Kansas Impound Auctions reserves the right to remove or withdraw from auction any vehicle at any time at its sole and absolute discretion.

REMOVAL

Successful bidders are responsible for loading and removal of any and all vehicles purchased. Any items not removed by removal date will accrue a $25/day storage fee (to be collected by seller at removal). Vehicles must be picked up and paid for within 3 business days from the date of the sale.

DEFECTIVE EQUIPMENT

No motor vehicle equipment (including a tire) that is the subject of a decision under section 30118(b) of Title 49 U.S.C. or a notice required under section 30188(c) of Title 49 U.S.C. is sold for installation on a motor vehicle.

INDEMNIFICATION

You agree to indemnify, defend and hold Kansas Impound Auctions, its officers, directors, employees, agents, shareholders, partners, affiliates, representatives and agents (the "Indemnified Parties") harmless from any claims, causes of action, lawsuit or damages (including attorney's fees) incurred by or imposed against the Indemnified Parties resulting from your use or misuse of the Web site or Kansas Impound Auctions services or breach of this Agreement. Buyers who are California residents expressly waive California Civil Code 1542, which states: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."
Privacy Notice Information requested by Kansas Impound Auctions will be used solely for registration and account maintenance. Your information will not be disclosed to anyone without the prior written consent of the Buyer. Kansas Impound Auctions does not sell buyer information.
